EU SEND: a secure document exchange platform in DG Competition

EU SEND is a web based exchange platform that ensures secure transmission of documents between DG Competition and external stakeholders. 

Due to an internal IT maintenance operation, sending documents with EUSend web will not be possible from Friday 28th of March at 12:00 until Monday 31st of March at 9:00

EU SEND in replacing eTrustEx as of 11/11/2023.

EU SEND serves as a secure communication channel to send documents to DG Competition. EU SEND supports message encryption, message integrity through the use of checksum algorithms, 2-factor authentication via EU Login and traceability. For more information download the EU SEND user guide:

The current limits for document transmission via EU SEND are the following:

  • Maximum size of transmission: 4GB
  • Maximum size of each file uploaded in the same transmission: 100MB
  • Maximum number of files uploaded in the same transmission: 500
  • Zip/7z and split zip files are not supported
  • Links should not be included in the message field. Links in the message field will not be opened, documents stored under such links are not considered as part of the submission.

For Merger cases you can use EU SEND to submit to the Commission, for example:

  • Draft Form CO
  • Responses to Requests For Information
  • Responses to requests for internal documents, if smaller than 4 GB
  • Response to a Statement of Objections
  • Submission of draft remedies
  • Any other submission to the Commission

For Antitrust cases you can use EU SEND to submit to the Commission, for example:

  • Complaints
  • Comments on complaints
  • Responses to Requests For Information
  • Response to a Statement of Objections, a Preliminary Assessment or comments on the Article 7(1) letter
  • Any other submission to the Commission

For Foreign Subsidies cases you can use EU SEND to submit to the Commission, for example:

  • Draft Form FS CO
  • Responses to Requests for Information
  • Responses to requests for internal documents, if smaller than 4 GB
  • Comments following the opening of an in-depth investigation
  • Observation on the Commission’s grounds on which it intends to adopt its decision
  • Submission of commitments
  • Any other submission to the Commission

For Digital Markets Act cases you can use EU SEND to submit to the Commission, for example:

  • Responses to requests for information (Art. 21 DMA)
  • Form GD and Draft Form GD (Art. 3(3) DMA)
  • Request for regulatory dialogue on compliance with Art. 6 and 7 DMA (Art. 8(3) DMA)
  • Reasoned requests for suspension or exemption (Art. 9 & 10 DMA)
  • Compliance and audit reports (Art. 11 & 15 DMA)
  • Information about concentrations (Art. 14 DMA)
  • Submissions to the Commission pursuant to Articles 17, 18, 19, 24, 25, 29 and 34 DMA
  • Any other submission to the Commission pursuant to the DMA and the Commission Implementing Regulation

 

For submissions larger than 4GB, please either split into more sendings or use a physical external carrier (DVD, USB, external hard drive).

NOTE: Users who had access to eTrustex (the predecessor of EU SEND) do not need to register as their accounts/access rights have been automatically migrated to EU SEND.
