Merger control in the EU – further simplification of procedures

Target group

All citizens and organizations are welcome to contribute to this consultation. The most affected groups of stakeholders include undertakings that have to comply with the provisions of EU merger control law and EU citizens and undertakings that benefit from effective EU merger control. Other important stakeholders are industry and business organisations, consumer associations, formal and informal associations of professionals in EU competition law and policy, as well as national competition authorities, national ministries and other government bodies in charge of competition law and policy, and academia.

Objective of the consultation

The present consultation is a short targeted additional public consultation, in the context of the ongoing review of EU merger control aimed at further simplifying and streamlining of EU merger control procedures, following the consultation on the draft revised Merger Implementing Regulation (“Implementing Regulation”) and Notice on Simplified Procedure that took place in May 2022. It concerns a proposed modification to Article 9 of the Implementing Regulation. The referred article provides for the suspension of time limits under certain circumstances and details the circumstances under which the suspension ends. The proposed amendment aims to clarify that the Commission has the possibility to restart the clock ex officio where the information requested is no longer necessary.

Interested parties are invited to submit their comments by 19 October 2022.
