Consultation on the Prolongation of the State aid Regulations and Guidelines reformed under the State aid modernisation (SAM) package and expiring by the end of 2020

Target group

Public authorities, citizens, companies and organisations are welcome to contribute to this consultation. Contributions are particularly sought from the national authorities dealing with State aid rules.

Objective of the consultation

The State aid rules reformed under the State aid modernisation ('SAM') package mostly expire by the end of 2020. On 7 January 2019, the Commission launched the evaluation of the above-mentioned rules under the form of a “fitness check”. On this basis, the Commission may decide in the future whether to further prolong or possibly update the above-mentioned rules. Considering the wide scope of the fitness check and the fact that the results of the evaluations will not be available before beginning 2020, a policy decision on the design of the rules post 2020 cannot be taken on time to ensure legal certainty and stability for the stakeholders as regards the applicable rules post 2020. Therefore, a short prolongation of the validity of the current rules is needed to allow on the one side a proper assessment of the rules and on the other side to ensure predictability and stability for Member States and the stakeholders until when the Commission can take an informed decision on the design of the State aid rules post 2020.

Consequently, the Commission has made a proposal to prolong by two years the validity of the following State aid rules:

  • General Block Exemption Regulation no 651/2014
  • De minimis Regulation no 1407/2013
  • Guidelines on regional State aid referring to the regional aid maps
  • Guidelines on risk finance aid
  • Communication on State aid for important projects of common European interest
  • Guidelines on State aid for environmental protection and energy
  • Guidelines on State aid for rescuing and restructuring
